1. Provider

These Terms and Conditions apply to all purchases made through the Payhip shop of:

Hereinafter referred to as “Provider”, “we”, “us” or “cplomedia”.

2. Scope

These Terms and Conditions apply to all digital products offered and sold through our Payhip shop. These include, in particular, sound effects, music loops, music tracks, ambiences, game audio files, audio sample packs and similar digital content.

Any deviating terms and conditions of customers shall only apply if we have expressly agreed to them in writing.

3. Conclusion of Contract

The presentation of products in the Payhip shop does not constitute a legally binding offer, but an invitation to place an order.

The purchase contract is concluded once the customer completes the checkout process via Payhip and the payment has been successfully processed. After the purchase, the customer receives access to the download of the digital products.

The technical processing of the purchase, payment processing and delivery of the download are handled through the Payhip platform.

4. Digital Products and Delivery

All products offered are digital products only. No physical goods will be shipped.

After successful payment, customers usually receive a download link or access to the purchased files via Payhip. The availability of the download may depend on technical systems, Payhip, payment providers or internet connections.

If a download does not work, customers may contact us by email. We will make reasonable efforts to resolve the issue as quickly as possible.

5. Prices and Payment

All prices shown in the shop are displayed in the respective stated currency. Depending on the customer’s country, platform settings and Payhip settings, taxes or fees may be calculated and displayed automatically by Payhip.

Payment is made using the payment methods offered in the Payhip shop, such as credit card, PayPal or other payment methods provided by Payhip.

6. Usage Rights / License

By purchasing a digital product, customers receive a simple, non-exclusive, worldwide and perpetual license to use the included audio files in their own projects.

Usage is permitted in, for example:

films, videos, YouTube productions, social media videos, computer games, mobile games, apps, theatre productions, podcasts, audio dramas, trailers, advertising productions, presentations and similar audiovisual or interactive projects.

The audio files may be edited, cut, looped, mixed, mastered and combined with other media within such projects.

7. Prohibited Use

The following is not permitted:

Reselling the audio files as a standalone product.
Sharing, publishing or distributing the files in unchanged or only slightly modified form.
Uploading the files to other asset stores, sample platforms, music libraries, stock audio portals or personal shops.
Distributing the files, whether free of charge or commercially, as a sound library, sample pack, music pack or download collection.
Claiming to have created the unmodified original files yourself.
Using the files to train AI models if this makes the original files or substantial parts of them extractable or reconstructable.

All rights to the original files remain with cplomedia / Christoph Plohovich.

8. Copyright

All audio files, music tracks, sound effects, product images, texts and other content offered are protected by copyright.

The purchase does not transfer copyright ownership. Customers only receive usage rights within the scope described above.

9. Right of Withdrawal / Cancellation Right for Digital Content

Consumers generally have a statutory right of withdrawal for distance contracts.

However, for digital content that is not supplied on a physical medium, the right of withdrawal may expire if the customer expressly agrees that performance begins immediately and confirms that they thereby lose their right of withdrawal.

Since our products are made available digitally immediately after purchase, the right of withdrawal expires once the download or provision has begun and the legally required consent has been given.

If no immediate download takes place or if mandatory legal rights apply, those rights remain unaffected.

10. Refunds

As the products are digital goods that can be downloaded immediately after purchase, refunds are generally excluded unless there is a legal entitlement.

A refund may be granted after individual review, for example in cases of technical problems, duplicate purchases or defective files.

In such cases, please contact us by email with your order number and a short description of the issue.

11. Product Descriptions and Technical Information

We make every effort to describe all products accurately. Information regarding the number of files, file formats, sample rate, bit depth, loopability and content is provided to the best of our knowledge.

Minor deviations that do not significantly affect the practical usability of the product shall not constitute a defect.

12. Liability

We are fully liable for damages resulting from injury to life, body or health, as well as for damages caused by intent or gross negligence.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations and only for foreseeable, typical contractual damages.

Liability for compatibility issues with specific software, game engines, DAWs, plugins or platforms is excluded, provided that the files are supplied in common audio formats.

13. Availability of the Shop

We strive to ensure that the shop is available with as few interruptions as possible. Since the shop is operated via Payhip, technical disruptions, maintenance work or outages may occur outside our control.

14. Communication

Communication generally takes place by email. Customers are responsible for providing a correct email address when purchasing.

15. Applicable Law

Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

Mandatory consumer protection laws of the country in which the customer has their habitual residence remain unaffected.

16. Dispute Resolution

We aim to resolve any disagreements directly and fairly. In case of problems, please contact us first by email.

17. Final Provisions

Should individual provisions of these Terms and Conditions be invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
